The CEO Effect, LLC is a business strategy and business consultation service.  The CEO Effect, LLC is concerned with the privacy and security of our customers, respondents and visitors. The CEO Effect, LLC is committed to protecting the data you share with us. This privacy policy explains how The CEO Effect, LLC processes information that can be used to directly or indirectly identify an individual (“Personal Data”) collected through use of its website and platform.

If you are a Visitor to our website only, and not a Respondent to a opt-in or a user of our platform, then this section is relevant for you.

2.3 Respondents
Respondents should be aware that in responding to invitations, they could be disclosing information that could make them personally identifiable to The CEO Effect, LLC Users. The security and privacy protection implemented on The CEO Effect, LLC’s platform does not cover this type of transfer or disclosure of personal information. Respondents responding to opt-ins should be aware that they alone are responsible for the content of their responses. For more detailed information concerning the protection of privacy when responding to opt-ins, Respondents may contact the entity conducting the opt-in. It is the User’s responsibility to ensure that collection and processing of data is done in accordance with applicable law. The CEO Effect, LLC will not process Personal Data of Respondents for other purposes or by other means than instructed by its Users.

2.4 Users
2.4.1. General

In order to provide services to its Users, The CEO Effect, LLC collects certain types of data from them.
During a User’s registration and later on The CEO Effect, LLC’s platform, they provide information such as name, company name, email, address, telephone, credit-card number and other relevant data. This information is used by The CEO Effect, LLC to identify the User and provide them with support, services, mailings, sales and marketing actions, billing and to meet contractual obligations.

The CEO Effect, LLC Users can at any time access and edit, update or delete their contact details by logging in with their username and password to The CEO Effect, LLC’s platform. The CEO Effect, LLC Users may create more Users with different privilege levels within their account. It is the responsibility of the User that creates other User accounts, to choose the level of access each User should have. Once these new Users log into The CEO Effect, LLC, they meet the definition of User in this policy. The CEO Effect, LLC will not retain User data longer than is necessary to fulfill the purposes for which it was collected or as required by applicable laws or regulations.

2.4.3 Collection of Respondent data
Opt-ins used for gathering feedback are created by Users, who make them available to relevant businesses, organizations, and individuals. It is the User’s responsibility to ensure that collection and processing of data is done in accordance with applicable law. The CEO Effect, LLC will not process Personal Data for other purposes or by other means than instructed by its Users.
Respondent data includes data from individuals uploaded, transferred or manually entered by a The CEO Effect, LLC User into their account for the purpose of providing feedback to the User by responding to opt-ins. Personal Data may include, personal contact information such as name, home address, home telephone or mobile number, email address, information concerning family, lifestyle and social circumstances including age, date of birth, marital status, number of children, employment details, education/qualification, business contact details, gender, religion, race, health detail and other sensitive Personal Data. Answers to questions by Respondents, may also include Personal Data.

The purpose of collecting Personal Data as part of a opt-in will vary depending on the opt-in, as set up by The CEO Effect, LLC’s Users. As The CEO Effect, LLC provides opt-ins to a wide group of customers and businesses, the purpose may vary greatly. For Users in the EEA, or for Users providing opt-ins to Respondents in the EEA, the User will be the “controller”, as defined in the Directive and the GDPR. The purpose will consequently be defined by The CEO Effect, LLC’s User.

If you or your organization are required under the European Union’s General Data Protection Regulation (GDPR) to enter into a contract, or other binding legal act under EU or Member State law, with your data processors, review and accept The CEO Effect, LLC’s Data Processing Agreement in your The CEO Effect, LLC account.

2.4.4. California Online Privacy Protection Act

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. 2.4.4.1 Processing in the European Economic Area (EEA)

For Users with accounts located in Europe, all processing of Personal Data is performed in accordance with privacy rights and regulations following the General Data Protection Regulation (GDPR), and The CEO Effect, LLC’s processing will take place in accordance with the GDPR.

2.4.4.2 Processing in the United States of America (US) and Canada
For Users with accounts in the US and Canada, The CEO Effect, LLC safeguards against accidental, unauthorized or unlawful destruction, loss, alteration, disclosure, access, use or processing of the User’s data in The CEO Effect, LLC’s possession. The CEO Effect, LLC will promptly notify the User in the event of any known unauthorized access to, or use of, the User’s data.
The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to:
• Process orders and to send information and updates pertaining to orders.
• Send you additional information related to your product and/or service
• Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.

To be in accordance with CANSPAM, we agree to the following:
• Not use false or misleading subjects or email addresses.

Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:          We will notify you via email Within 7 business days of The CEO Effect, LLC’s knowledge of the breach.

We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.
